The National Innovation Visa (NIV) is open

The Subclass 858 National Innovation visa (NIV) is open

The NIV is open. Applicants are able to start the NIV visa process. This starts with an assessment, and ends with a visa application.
NIV process
To submit an application, much like the General Skilled Migration program, applicants will require a formal visa invitation from the Department of Home Affairs (DHA).
The NIV visa application process involves a number of stages.

Assessment – Are you you eligible to apply for an NIV?

Are you a high achieving:

  • global researcher
  • entrepreneur
  • innovative investor OR
  • athletes and creative

Will your skills, experience, track record be recognised for the NIV?  And what does that look like? Are you in an occupation, or industry, that is deemed a priority sector? Are you a national, international, world or Olympic champion athlete or coach? For academics and industry leaders, have you recognised,  awarded and published? Have you received accolades across your industry? From national or global bodies? Are you a talented entrepreneur or innovative investor? Do you hold patents?

Nomination – Can you find someone who will support your claims? You will need to find a notable person, or Australian authority/body to support your application. That person, or should be someone of equal standing in Australia. Or should be the national authority in your field. It may be a state/territory government that you intend to establish your business, investment or want to commercialise your product. This person will provide a Nomination for you.

Expression of Interest (EOI) – If you can answer yes to the above, you can probably look to submit a formal Expression of Interest (EOI) with the DHA. You will need to back up some of your claims at this stage. You will need a CV, evidence of your achievements, possibly evidence of your Nomination. If it is a state/territory – who is the body, what is the the name and position of the person who will endorse your application.

Visa invitation – If the DHA support your application they will invite you to apply for an NIV visa.

Lodge your NIV application – Invited applicants will have 60 days to submit their application. In addition to  evidencing any claims made on your EOI, you will have to show that you, and your family, are of good health and character as well. Successful applicants – and their dependent family members –  will be granted a 5 year permanent residency visa. This will allow you to move to Australia, establish  yourselves in the country to ultimately remain as residents and provide a pathway to Australian Citizenship.

The National Innovation Visa - 7 December, 2024

New National Innovation Visa set to be launched from late 2024

 National Innovation visa

As we advised earlier this year, the National Innovation Visa is due to replace the existing Global Talent Visa in the coming weeks.

What do we know about the National Innovation visa?

We should know the specific criteria for the visa very soon. Some of the details we expect to see confirmed are as below.

Applicants will be considered across the following areas:

  • Researchers & Thought Leaders:  Global leaders, evidenced with significant published works, references, media coverage, awards.
  • Entrepreneurs: High performing entrepreneurs, particularly those with support from state/territory authorities.
  • Innovative Investors: Investors who have track record of successful investing, particularly those in innovative sectors.
  • Athletes, Coaches & Creative Talent: High performing athletes or sports coaches, musicians, artists, actors, filmmakers.

The National Innovation Vise will be a permanent residency visa. This is a change for some of the above applicants. Specifically Entrepreneurs and Investors who had to apply for  the (now closed)  Subclass 188 visa. The 188 visa is a temporary residency visa, which has to be followed by an application for permanent residency through the Subclass 888 visa.

It is expected the visa will be by invitation only. Applicants will need to nominated by an equally accomplished Australia Citizen or permanent resident, or an organisation or government authority,  that can vouch for the applicant’s credentials and achievements.

Applicants (over 18 years old) will need to have functional English, or pay a further visa application charge prior to visa approval.

Eligible family members can be included. All applicants will need to meet health & character requirements.

There will be no limitations in occupations, or age limits. States/territories may have a say with regards to the industries and experience  that they are looking for and that they will support through nomination.

Are you interested?

It is expected that the visa will be in high demand.

While we all wait for the final details of the National Innovation Visa to be released, potential applicants can register their interest with us. We have a number already and the list is growing.

These include, athletes, investors & entrepreneurs.

The National Innovation visa – A new immigration program

The launch date and criteria hasn’t been confirmed.

Visa to replace the BIIP & Global Talent visa programs

The National Innovation visa will replace the Business Innovation and Investor Provisional (Subclass 188) visa program. As well as the Global Talent (Subclass 858) visa.

The BIIP program will now be officially  closed. Although it has been effectively closed since 1st July 2023, when the states/territories weren’t allocated any 188 visa places.

This follows the closure of the permanent residency Subclass 132 Business Talent (Permanent) visa on 1st July, 2021.

Who is the National Innovation visa for?

The visa be targeted at High-calibre Talent including:

  • Researchers & Thought Leaders
  • Entrepreneurs
  • Innovative Investors
  • Athletes & Creatives

What type of visa?

Unlike the BIIP program, the National Innovation visa is likely to be a permanent residency visa.  It will however, like the Subclass 132 visa,  be monitored to ensure applicants comply with their intentions.

Under the BIIP applicants were initially granted temporary residency,  with a pathway to apply for permanent residency after at least 4 years of business/investment activity.

Why is the visa being introduced?

The government in recent years has undertaken a review of the Migration Strategy.

The findings of the review included, that the BIIP temporary residency visa holders, especially the Business Innovation Stream,  weren’t providing the economic benefit they should and could have.

Alternately, there is a recognition that applicants who have held, or hold, the Subclass  the Significant Investor Stream do provide economic benefit. A significant investment is an in investment of at least AUD $5m into complying investments.

Are you interested?

It is expected that the visa will be in high demand. Applicants will need to be ready to submit their interest, potentially seek state/territory nomination and then submit an application as soon as they can.

While we all wait for the details of the National Innovation visa to be released, potential applicants can register their interest.

We will discuss your credentials as a entrepreneur, major investor or research history. We will make introductions to professional service providers that can assist in preparing for the application.

Cryptocurrency in the investor & business visas world … Uglobal Immigration magazine

Uglobal Immigration magazine

Recently we shared some comments we made to Uglobal Immigration magazine about visa options for same sex partners.

We have again been asked to provide comments. This time with regards to cryptocurrency in investor visas. Our response was recently published in an article on the Uglobal Immigration website.

Mark Welch, who is the founder of Australian law firm Cargil Migration, said that based on his recent conversations with the Australian Department of Home Affairs (DHA) officials, he can confirm that digital currencies are excluded as a source of funds or assets, and therefore, could not be used for investment immigration.

“The DHA is unable to track digital currencies and, therefore, verify that the funds are lawful. Any funds which cannot be confirmed as lawful, can’t be considered in the Business Innovation and Investment visas,” Welch said.

It’s always great to be able to contribute to leading industry magazines & forums.

We were recently asked to provide comment on Australia’s recognition of same sex partners for investor visas. Our response was recently published in an ARTICLE on the Uglobal Immigration website.

Mark Welch, another Registered Migration Agent from Australia who founded the law firm Cargil Migration, added that same-sex applicants have to provide “evidence that the relationship is mutually exclusive, and is genuine and continuing. Evidence can include financial aspects, nature of the household, social aspects of the relationship and the nature of your commitment.”

Australian visa program update – October 2020

Australia confirms commitment to permanent migration for the 2020 to 2021 financial year

In early October the Australian government announced their federal budget for the 2020-2021 financial year.

On the back of the budget the DHA (Department of Home Affairs) outlined details for their permanent migration program. The below is an overview of these changes.

Migration program focus

The government announced, due to the COVID pandemic, that the focus of the migration program for 2020-2021 is “on supporting our economic recovery, growing Australian businesses and creating jobs for Australians”.

Migration program numbers

The DHA confirmed the permanent migration program numbers will remain at a cap of 160,000. This includes:

  • 79,600 places in the Skilled stream
  • 77,300 places in the Family stream.
  • 3,100 in the Child and Special Eligibility visas

The government anticipate that two thirds of the visas will be allocated to people in Australia.

The remaining visas will then likely be split between the skill stream (two thirds) and the family Stream (one third).

Migration program – Skilled visas

A key target of the skilled visa program will be innovators, investors and job creators. They will be encouraged to apply through the Global Talent, Business Innovation and Investment Program (BIIP) and Employer Sponsored Visas.

Global Talent Visa – places tripled

A particular focus will be the Global Talent Independent (GTI) Visa. The program for the new financial year will triple from 5,000 to 15,000 places. The target of this visa will be individuals in industries such as:

  • AgTech
  • Space and Advanced Manufacturing
  • FinTech
  • Energy and Mining Technology
  • MedTech
  • Cyber Security
  • Quantum Information, Advanced Digital, Data Science and ICT
Business Investors – places almost doubled

The DHA have confirmed that they will double the number of places available for business investors to 13,500 places. The BIIP program will be streamlined and there will be changes to investment and residency requirements, ensuring the program is targeted at Australian venture capitals and emerging small and medium size businesses to support the economic recovery.

As of publishing this update, we are still awaiting on further details of the changes to be announced.

GSM Program – skilled migration remains open

Individuals and their family members can still look to submit an EOI for the GSM program. This includes the Skilled Independent visa  (Subclass 189) and the two State/territory nominated (Subclass 190 & 491) visas .

Subclass 189 – Skilled Independent visa

At present the DHA have announced that the focus on the Subclass 189 invitations  will be on those occupations listed on the Priority Migration Skilled Occupation List  (PMSOL).

It is expected that the required points are likely to remain high. However the 11th October invitation details are yet be released.

State/Territory nominated visas – Subclass 190 & Subclass 491

The opportunity to be nominated for either of the state/territory nominated GSM visas will remain. At the time of writing, the majority of the states/territories have programs in place to allocate nominations to eligible onshore applicants.

For offshore applicants, we are still waiting on the states to confirm their program. These are likely to be released in the weeks and months leading up to Christmas. For example:

  • South Australia have pushed back the release of their lists from mid-October to November.
  • NSW  have also confirmed that they will announce changes to the management of the Skilled Work Regional Visa (subclass 491) in due course.
  • Queensland have stated that they plan to re-open the program in December 2020.

Migration Program – Family stream

The majority of visas within the Family stream will go to partners, with almost double the places (72.300) compared to the previous financial year. The aim to give more certainty to those wanting to settle in Australia with their partners and plan for their futures.

Humanitarian Program

The DHA have confirmed their commitment to a Humanitarian Program. A cap of  13,750 places, similar to last year. In numbers, Australia remains the third most generous humanitarian resettlement country in the world.
