The National Innovation (NIV) visa 

The National Innovation visa, came into effect from 7 December, 2024.

The  NIV visa aims to attract top talent from across the world, to move to Australia, and contribute to the nations growth.

This visa, in effect, replaces the Business Innovation and Investment Provisional (BIIP) programs (Subclass 188 and Subclass 888 visas) and the Distinguished Talent visa (Subclass 858).

Who can apply? 

The visa provides permanent residency for:

  • Global researchers
  • High-performing entrepreneurs
  • Innovative investors and
  • Athletes and creatives

Invitation only

The visa is an invitation only application. Applicants need to submit an Expression of Interest (EOI) and be invited to apply by the DHA.

Visa Application 

Applicants as part of the EOI will need to detail  relevant achievements & success across their career. When an applicant submits an application they will need to provide documentation to evidence these.

Nomination requirement 

Applicant will need to be nominated by:

  • An Australian Citizen, or permanent resident OR
  • A Commonwealth, State or Territory Agency

Entrepreneurs & Investors 

As was required with the BIIP programs – Subclass 188 & 888 visas – it is expected that entrepreneurs and investors will need to be supported by a state/territory agency.

The requirements will likely include both successful entrepreneurs & investors, as well as those who are looking to commercialise a service of product in Australia.

At the time of publishing these details, the states/territories have not confirmed their requirements. We will confirm these when they are.

The Tier One Sectors include:

  • Renewables and Low Emission Technologies
  • Health Industries

Tier Two Sectors

  • Agri-Food and AgTech
  • Defence Capabilities and Space
  • Education
  • Financial Services and FinTech
  • Infrastructure and Transport
  • Resources

Permanent Residency  

Successful applicants, and their dependents, will be granted permanent residency.  They will have access to education, health and other rights that other permanent residents have.

Support Services

As with previous global talent, business & investor visas, this visa will likely require significant planning.

In order to prepare and meet the requirements consultation with financial advisers, accountants, lawyers, venture capital, fund mangers and other professional service providers in Australia may be required.
